The European Patent with Unitary Effect and the Unified Patent Court are ready for take-off: as of 1 June 2023, the European Patent Office (EPO) will be able to approve granting of “European Patents with Unitary Effect”, meaning patents that are valid in all Member States of the European Union who adhere to the Enhanced Cooperation in the Creation of Unitary Patent Protection. Jurisdiction over these patents is reserved to the “Unified Patent Court” (the “Court”), in implementation of the so-called “Agreement on a Unified Patent Court” (the “Agreement”) and the relative “Rules of Procedure”. chevron_right

Austria has finally deposited the instrument of ratification for the Unified Patent Court (UPC), thus activating the entry into force clause of the Protocol for the Provisional Application of the UPC Agreement on January 19th. chevron_right
